(hereinafter referred to as "GoodCall" or “Agency”)

 

for the use of the website www.binary-jobs.com by Candidates

(hereinafter referred to as "GTC")

 

I.               GENERAL PROVISIONS

1.1 These general terms and conditions (GTC) govern rights and obligations which apply in the legal relationship between GoodCall as the owner and operator of the Website and the Candidate using the Website www.binary-jobs.com (Website) and the corresponding services which GoodCall provides through the Website (Services). Through operating the Website, GoodCall provides the Candidate with an opportunity to get connected with Hiring Clients through the Website to find employment. GoodCall and the Candidate are collectively hereinafter referred to as the Parties.

1.2 The Candidate creates a profile through the Website by creating an account with relevant information about themselves, including work experiences, skills, and preferences (Sign up) to get employment offers from Hiring Clients.

1.3 Applicable privacy policy shall constitute an integral part of these GTC. These GTC are binding for both of the Parties.

1.4 Whenever written with initial capital letters in these GTC including its recitals, except where the context clearly requires otherwise, each of the terms set forth shall have the following meaning:

a)     “Annual gross income” gross income (excluding any bonuses, additional or other monetary payments provided from the Hiring Client to the Candidate) that is expected to be accumulated for the period of the first twelve (12) months after the constitution of the Employment agreement;

b)     “Candidate”, an individual who is using the Website and is seeking employment;

c)     “Candidate Placement” means when the Candidate accepts an employment offer made by the Hiring Client resulting in entering into a binding Employment Agreement or other such agreements which may be required in accordance with the employment offer. This includes arrangements such as part-time work via the Candidate’s freelancer license.

d)     “Hiring Client”, an individual or legal entity that uses the Website and Services of GoodCall for the purpose of hiring Candidates;

e)     “Employment agreement” for the purpose of conclusion of the Employment agreement any contract, agreement or other legal relationship, under which the Candidate will work or perform for the Hiring Client and which regulates mutual rights and obligations of the Hiring Client and Candidate, regardless whether such contract, agreement or other legal relationship will be concluded orally, in writing or whether it was created explicitly or de facto or according to legislation and regardless the legislation of which this relationship will be governed;

II.              RIGHTS AND OBLIGATIONS

2.1   All information provided by the Candidate during the registration on the Website shall be up-to-date and accurate.

2.2   GoodCall shall use the acquired data and information regarding the Candidates solely for the purposes of the hiring process on the Website (especially for evidence and getting connection with the Hiring Client) and shall not use the information or data otherwise.

2.3   Upon the registration of the Candidate on the Website the Hiring Clients are entitled to offer the Candidate relevant job position based on Candidate’s preferences including salary information. If the Candidate confirms interest in connecting with the Hiring Client, the Candidate give their consent to being contacted by the Hiring Client representative.

III.            FINAL PROVISIONS

3.1   The Website may contain links to third party websites which are outside of the control and responsibility of GoodCall and GoodCall is neither responsible for the content of third party websites, nor for any damage that may occur.

3.2   The Services and the Website are provided as is, and GoodCall does not warrant, expressly or otherwise, including but not limited to, that they a suitable for a certain user. GoodCall is not responsible for any direct or indirect damage, loss or injury which a third party suffers from as a consequence of the Hiring Client’s use of the Services and the Website.

3.3   GoodCall reserves the right to change or cancel a Service or a part of it, and/or to completely discontinue providing of the Website or the Services without prior notification while such action does not any right to compensation for any resulting direct or indirect damage or losses. These GTC will be applicable on all new functionality and/or new services provided from the Website.

3.4   GoodCall is entitled to transfer its rights and obligations in this GTC to a third party without the written consent of the user.

3.5   If any provision of the GTC is invalid or ineffective, or becomes invalid, instead of invalid clauses a provision will be enforced to the extent that the purpose of the invalid clause is as close as possible. The invalidity or ineffectiveness of one provision will not affect the validity of the other provisions.

3.6   The GTC and the legal relationships arising hereunder as well as disputes arising hereunder and in connection herewith shall be governed and construed in accordance with the laws of the Czech Republic.

These GTC becomes valid and effective on 1. 1. 2021.
